If you want some real legal advice, ask MI7 user guitarlawman. As well as being an amazing guitarist, he's also a top notch music business lawyer. He'll pretty much say what I've said though, just probably in more flowery language :-)

The RIAA have been prosecuting little old ladies and twelve year olds, so I have no doubt that they'd happily do you too.

Legally speaking, the copyright holder refuses permission unless and until you have active consent. The only way you can legally host this is by contacting the copyright holder (which is probably a publishing company) and asking them. They will almost certainly say no however.

I know, it sucks. But that's the law.

I have a disclaimer that I will remove a file immediately at copyright holder's request. If that doesn't seem adequate, I may discontinue the offering right away. Do you know if the FBI or whomever has convicted any small-time bloggers like myself?

Much as I personally approve of making good unknown music available to the public, you do realise that what you are doing in this case is technically illegal in the United States of America, and could lead to up to 20 years in prison? Yes, you'd get half that much for murder, go figure. Although the record is out of print, the copyright is still valid, and presumably still rests with the original songwriters and/or publishing company, and you need their permission before reproducing this.
